Direct-to-Artisan Collective Terms
By accessing or purchasing from HOZO, you support authentic tribal heritage and agree to the following legal terms.
1 Acceptance & Scope of Agreement
Welcome to HOZO (hozostores.com), operated by HOZO Stores Private Limited ("HOZO", "we", "us", or "our"). By browsing our gallery, registering an account, or purchasing any artwork, physical item, or bespoke service, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service, along with our Privacy Policy and Shipping Policy.
If you do not agree to these terms, please refrain from using the platform or placing orders.
2 Authenticity & Handcrafted Artisanal Variations
All artworks offered on HOZO are genuine, 100% handmade creations produced by indigenous tribal master artists and certified traditional artisans. Because each painting is crafted individually using natural organic pigments, handmade handmade paper, or treated canvas:
- Organic Character: Minor natural variations in pigment intensity, surface texture, and brush stroke dynamics are intrinsic hallmarks of authentic handmade art and are not considered defects.
- Digital Display: We take extreme care to photograph artworks under standardized 5500K color-calibrated gallery lighting. However, slight variations in shade may occur depending on your device display calibration.
- Certificate of Authenticity: Every artwork is delivered with an official serialized physical and digital Certificate of Authenticity (COA) specifying the artwork provenance.
3 Intellectual Property & Artist Copyright Protection
All content on the HOZO platform—including artwork designs, photographs, artist biographies, text descriptions, logo trademarks, and software code—is the protected intellectual property of HOZO and its partner artists under the Indian Copyright Act, 1957 and international copyright treaties.
Ownership vs. Copyright:
When you purchase an artwork from HOZO, you acquire full title and physical ownership of the tangible art object. However, all moral rights, digital reproduction rights, and commercial exploitation copyrights remain exclusively reserved with the artist and HOZO. You may not duplicate, print commercial merchandise from, or mass-produce digital replicas without prior written licensing authorization.
4 Pricing, Invoicing & Taxes
- Currency: All prices listed on the storefront are denominated in Indian Rupees (INR ₹).
- Goods and Services Tax (GST): All listed product prices are inclusive of applicable GST unless explicitly stated otherwise. A tax invoice with GST breakdown is provided for every order.
- Price Revisions: HOZO reserves the right to modify prices, launch temporary promotional discount campaigns, or correct typographical pricing errors without prior notice. Price changes will not affect orders already confirmed.
5 Orders, Payment & Contract Formation
An order placed through our website constitutes an offer to purchase. A binding sales contract is formed when you receive our formal Order Confirmation with a unique Order ID.
- Payment Modes: We accept major Credit/Debit Cards, Net Banking, UPI (Google Pay, PhonePe, Paytm, BHIM), and Cash on Delivery (COD) for eligible domestic pin codes.
- Order Verification & Fraud Prevention: We reserve the right to cancel or hold orders flagged as suspicious, fraudulent, or containing unverified shipping addresses. In case of cancellation of a prepaid order, a 100% refund is credited immediately.
6 Limitation of Liability
To the maximum extent permitted by applicable Indian law, HOZO Stores Private Limited and its directors, officers, and artisan partners shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from the use of the platform, carrier delivery delays caused by force majeure events (natural disasters, weather disruptions, civic strikes), or third-party payment gateway downtime.
In all events, our aggregate liability shall not exceed the actual invoice amount paid by you for the specific artwork giving rise to the claim.
7 Governing Law & Jurisdiction
These Terms of Service and any contractual disputes arising from the purchase of artworks on HOZO shall be governed by and construed in accordance with the laws of the Republic of India. The competent courts in India shall have exclusive jurisdiction over any legal proceedings arising hereunder.
